Welcome to GoGetNow. We look forward to being of service to you and will set out all our processes and methods below. But if you have any question, please do not hesitate to contact our Instant Care Team care@gogetnow.xyz.

These Terms and Conditions (Terms) will apply when you order any services from us using our website(s) www.gogetnow.xyz, our mobile applications, or any of our other applications and related services (which we simply like to refer to the Application). The Terms are a legally binding agreement between you and us (GetNow Delivery Holdings Ltd ), (GoGetNow), which makes us official. Just one more thing, these Terms apply to the exclusion of other terms or conditions that you may want to impose.

We would like you to fully understand what utilising our service entails and would ask that you take a moment to read through these terms before registering for a GoGetNow account (Account) or using our application. By setting up an account with us and using the Application, you confirm that you’ve read the Terms, and understand them and that you’ll be bound by them, just as we are, we may from time to time need to make some changes to these Terms but rest assured that we’ll let you know of any changes when they’re published on our application.

If we have to speak to you, we’ll do so using the contact details you provide when setting up your Account.

  1. Our Services
    1. GoGetNow is here to offer online shopping flexibility to you. Our aim is always to exceed your expectations in shopping for your instant needs, which we believe is currently limited by curated lists and dark store structures.
    2. Our services (Services) are easy to find and you can find them on our website www.gogetnow.xyz. The details of our Services, and any limitations (such as the parcel size, its weight limit, and location), are set out on our website www.gogetnow.xyz to make it easy for you. Keep in mind that we may need to update it from time to time to keep delivering the awesome service you expect.
    3. Our Services are provided using awesome GoGetNow riders (Riders) and are based on prescribed zones within 2 miles from the delivery address.
    4. While we always work hard to make your life that little bit easier through offering our Services reliably and in keeping with your Delivery Request (as outlined below), the availability of our Services may vary depending on, among other things:
      1. the number and availability of Riders in your location;
      2. retail opening hours; and
      3. in certain circumstances, the availability of an item within your location.
  2. Your Account
    1. You’ll need to set up an account before you can use our application. When you open your account, we’ll send you an OTP (One Time Pin) on the number you provide during registration. Please enter the OTP into the Application and share with us some more details (as explained in our FAQs here) and provide credit card details. You agree to keep the information in your account (including any payment or contact information) accurate, complete and up to date.
    2. You’re responsible for the activity that occurs on your account. We trust that you’ll keep your account secure and GoGetNow won’t be liable if someone else gets their hands on the Application account through using your Account (unless this is the result of us not keeping your log-in details secure, which we work tirelessly to ensure we do).
    3. You may close your account at any time through sending a request in the account section of our application, or by getting in contact at care@gogetnow.xyz. If a Delivery Request (as laid out below) is pending at the time you close your account, you may still be charged for the full amount of the Delivery Request.
    4. While it would pain us to do so, we may suspend access to your account, or close it permanently, at our discretion, should it not be in GoGetNow’s interest for you to continue using the application. Such circumstances may include, but aren’t limited to:
      1. if we consider that your account is being used by someone else;
      2. if you use your account for an excluded Items (as defined below); or
      3. if you’re otherwise, in our opinion, abusing the application or our Services (for example, by mistreating our Riders or being repeatedly unreasonable).
  3. Delivery Request and Charges
    1. When you place a request for a delivery (Delivery Request), one of our riders will need to accept it before the request can be confirmed. We do this to manage your expectations and to make sure that you’re able to get what you want, as soon as possible. Payment is taken once we allocate a rider to your request. If we aren’t able to assign the rider, then you will be refunded.
    2. We’ll send you a notification through the application once your Delivery Request has been accepted, at which point a contract comes into force between us with respect to the delivery of the item(s) specified in the Delivery Request. A Rider will be dispatched to fulfil your request and get your order to you when you need it.
    3. Our charges (Charges) are as follows:
      1. the cost of any item ordered (the Item Cost);
      2. a delivery fee (which, put simply, is the Rider fee. 100% of the delivery fee goes to your awesome rider);
      3. a service fee (a small service fee that allows us to keep things moving);
      4. a card transaction fee (this is our payment processing fee;)
      5. a reserve amount (to cover difference in price). A reserve (the Reserve) amount is transferred to your account with regards to each Delivery Request. The amount will either be £1.00, or 10% of the cost of the item you request for delivery, whichever is the higher amount. The Reserve is used to cover the cost of any price discrepancies of the item ordered, because we all know how the universe operates. This way, we’re better positioned to get your item delivered to you with the littlest delay. Any unused amounts of the Reserve will be refunded to you following delivery. Any refunds will be provided to you within 14 days of making the Delivery Request, but we’ll try our best to get it to you sooner, of course; and
      6. a rider tip (completely at your discretion).
    4. When you place the order, we’ll let you know what the amount of the Charges will be. Charges will be collected at the point when we accept the Delivery Request.
    5. All Charges are exclusive of VAT and any applicable VAT will be added to your receipt.
  4. Tips
    1. When you place a Delivery Request, you’ll have the option to pay an additional discretionary amount by way of tip to the Rider. It’s just a way to show your appreciation to our Riders, who really appreciate it too. Any payment made will be collected by GoGetNow using the payment method used for the Delivery Request and all such amounts will be delivered in full to the Rider.
  5. Delivery
    1. Once a Delivery Request has been accepted, our Riders will make every effort to ensure your delivery is made as soon as possible. Deliveries are made to the address notified to us in the Delivery Request. You’ll be able to track the progress of the Delivery Request using the application, so you’ll be informed of its progress at every step of the way.
    2. Even though our Riders will attempt to deliver your item as soon as possible, there are several factors that may result in an increased delivery time including, but not limited to:
      1. traffic;
      2. customer queues or retail opening hours; and
      3. weather conditions.
      4. mechanical issues
    3. If your delivery is delayed, we’ll contact you as soon as possible to let you know and will take steps to minimise the effect of the delay.  We dislike inconvenience as much as the next person.
    4. Where the delivery can’t be completed due to some unfortunate reasons within your control (e.g., because you gave us the incorrect address, or where you didn’t provide suitable delivery instructions, if no one is available to take receipt of the item, or the delivery address is inaccessible), we’ll not be liable for any delay or the failure to complete the Delivery Request and you may be charged the full amount of the Charges.
    5. Where the delivery is substantially delayed or it can’t be completed for reasons out of our control, the Care team will be in contact with you to discuss further steps.
    6. Our Riders won’t be required to complete a Delivery Request:
      1. if to do so would result in them being in breach of GoGetNow policies (regarding, for example, the delivery of age-restricted items);
      2. if the recipient is, or appears to be, under the influence of alcohol or a controlled substance; or
      3. if delivery for any reason makes a Rider feel vulnerable, and

in any such circumstances you’ll be charged the full amount of the Charges.

  1. Cancellation
    1. You can always cancel your Delivery Request free of charge until the moment a Delivery Request has been assigned to a rider.
    2. Once a Delivery Request has been accepted and a Rider is dispatched, you can still cancel your Delivery Request but you may still be charged the full amount of the Charges, depending on the circumstances.
    3. We can cancel a Delivery Request for any reason. If we do cancel a Delivery Request, you’ll not be charged unless the reason for the cancellation is because you’re not following our policies e.g., with regards to the delivery of an age-restricted item, or due to you failing to provide complete and accurate instructions. Customers may return items purchased through GoGetNow directly to the store. Return for a refund through our Service isn’t possible.
    4. Cancellation after the rider has purchased the goods is not possible. Goods will be delivered.
  1. Returns

Should you wish to return an item purchased through GoGetNow, you are welcome to go to the original store from which the item was purchased. Please take your original proof of purchase that we provide you with upon delivery with you to the store. The original seller determines the return policy. To eliminate any future inconveniences or disappointment, please ensure that you order the correct items.

  1. Age-Restricted Items
    1. Age-restricted items (including, without limitation, alcohol or cigarettes) are items that can only be sold to people who have reached a particular age according to the local law.  For example, alcohol can only be sold to someone 18 years old or over.
    2. By placing any order for an age-restricted item, you confirm that you and, if different, the proposed recipient of the item, have reached the relevant age. We’ll ask you to re-confirm this when you make a Delivery Request through the application.
    3. If a Delivery Request contains an age-restricted item, our Riders may ask you to provide valid proof of age and identification before the delivery is completed, just to cover all our bases. Our Riders aren’t under any obligation to complete a Delivery Request unless they’re satisfied that the person receiving the item is old enough to legally purchase it. If delivery of any age-restricted item is not completed for this reason, you’ll still be charged the full amount of the Charges.
  1. Excluded Items
    1. There are certain items that GoGetNow won’t deliver (Excluded Items). These include, without limitation:
      1. illegal substances
      2. firearms, ammunition or explosives;
      3. knives or other weapons;
      4. hazardous chemicals. This includes all goods which, through their packaging or nature, may present a danger to or damage the environment;
      5. live animals;
      6. For the time being, orders worth more than £150.00 can’t be accommodated;
      7. [stolen property];
    2. If you use your account in relation to an Excluded Item, we may suspend access to or close your account.
  2. What if an item is wrong, damaged or lost?
    1. If you believe that the item delivered to you is the wrong item, or is damaged in any way, we’re sorry and ask that please let us know within 60 minutes of the delivery being made. We’ll do our very best to assist but can’t take responsibility for faulty products due to manufacturing errors or warranty issues. You’ll receive a receipt with your order and can follow up directly with the supplier if this is the case.
    2. We may request details of the problem, including visual or photographic evidence of the suspected damage to help speed things along. We’ll not be liable if we reasonably suspect that the identified damage was caused after delivery.
    3. If an item is lost, damaged or incorrect due to an action or omission caused by us or our Riders, other than factors which are out of our control (including, without limitation, you not providing accurate and complete instructions), we will, at your option, either provide a refund of the Charges (other than the card transaction fee) or re-arrange delivery free of charge.
    4. Any legal rights, statutory or otherwise, that you may have as a consumer in respect of the items (for example, in respect of items under a manufacturer’s warranty) must be taken up directly with the shop or other establishment at which the relevant item was purchased or, where relevant, with the manufacturer. Neither we nor our Riders will participate in any such discussion.
    5. If, for whatever reason, you would like to return an item purchased or delivered using our application, you may do so by placing a new Delivery Request, and in such event the Terms will apply to such request on the same basis as the original Delivery Request.
  3. What if a shop is closed?
    1. We try to know everything, but even we have our limitations. Therefore, it’s up to you to confirm the opening hours for the purposes of a Delivery Request.  Any Delivery Request must be made within 1 hour prior to the relevant shop or establishment’s closing time, just to give our Riders enough time to make it happen.
    2. If a delivery is not completed because of a shop, post office, or other establishment being closed (other than due to a delay caused by us), you’ll be refunded the Item Cost and half the delivery fee. The transaction fee will still be charged in this instance.
  4. Your obligations

By using our application to make a Delivery Request, you agree that:

      1. you’ll ensure that the image and description of any item in a Delivery Request is clear, complete and accurate. We won’t have any liability under these Terms in respect of any delivery where the image or description in the Delivery Request doesn’t meet these criteria;
      2. you’ll provide correct and complete delivery address details with suitable delivery and access instructions.
      3. you’ll provide any further information that we require to complete the Delivery Request within a reasonable time of us asking for it;
      4. you’ll, prior to making a Delivery Request, confirm the relevant opening hours in respect of the Delivery Request (which may include, for example, retail opening hours, or local post office branch hours) and make all Delivery Requests within 1 hour prior to the relevant shop or establishment’s closing time;
      5. you’ll not use our application in respect of an Excluded Item, or for any illegal purpose including, without limitation, for the delivery of an age-restricted item to a minor; and
      6. Our Riders will be treated with courtesy and respect, and the same will be applied to you. GoGetNow has a zero-tolerance approach to all forms of abuse.
  1. Data protection

The use of all personal data you submit to us, whether via our application or otherwise, or which we collect about you, is covered by our privacy policy, available here www.gogetnow.xyz/privacy-policy. You acknowledge that by using our services you have reviewed and agree to our privacy policy.

  1. Intellectual Property

Any intellectual property rights in these Terms and/or the Services (including, without limitation, rights in the GoGetNow brand) are, and will remain, owned by us and you shall have no rights to use the same save as expressly permitted by these Terms.

  1. Your legal rights and our liability: Please pay particular attention to this section
    1. Nothing in these terms will affect your legal rights. For detailed information about your rights please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06.
    2. We’re responsible to you for any loss or damage that you suffer that is a “foreseeable” result of our breaching these Terms or our failing to use reasonable care and skill in providing you with our Services. We’ll not be responsible for any loss or damage that is not foreseeable or that is out of our reasonable control. “Foreseeable” loss or damage is loss or damage that is obvious or that we both knew might happen. For example, loss or damage might be foreseeable due to information you provide us with at the time that you make a Delivery Request.
    3. We’re not responsible for any loss or damage that you suffer as a result of you breaching the Terms.
    4. To the extent that you use the products for any commercial, business or re-sale purpose, we are not responsible for any loss of profit, loss of business, business interruption or loss of business opportunity that you may incur.
    5. Our total aggregate liability to you in respect of a breach or related set of breaches of these Terms shall not exceed the greater of
      1. the total delivery and service fee paid by you to us in respect of the delivery of goods where the breach(es) occurred; and
      2. 125% of the total delivery and service fee paid by you to use in the 12-month period prior to the breach(es) occurring.
    6. Nothing in these Terms limits any liability which cannot legally be limited, including but not limited to liability for:
      1. death or personal injury caused by negligence;
      2. fraud or fraudulent misrepresentation;
      3. breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession); or
      4. where you are dealing as a consumer, any limitation of liability arising out of a breach of the terms implied under the Consumer Rights Act 2015.
  1. General
    1. Assignment.  We may transfer our rights and obligations under these Terms to another organisation. We’ll tell you if this happens and let you know how it might affect your rights under the Terms. You may not transfer any of your rights or obligations under these Terms unless we have agreed to this in writing.
    2. No partnership or agency. Nothing in these Terms is intended to, or shall be deemed to, establish any partnership between us or make us your agent.  GoGetNow and our Riders, in providing the Services, facilitate purchases and deliveries of specific items for you and neither we nor our Riders act as your agent or partner by doing so.
    3. Even if we delay in enforcing these Terms, we can still enforce them later. If we don’t insist immediately that you do anything you’re required to do under these Terms, or if we delay in taking steps against you in respect of your breach of these Terms, that won’t mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
    4. If a court finds part of these Terms illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    5. Third party rights. These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms. These Terms apply directly between you and GoGetNow and are not enforceable by any third party.
    6. Governing law and Jurisdiction. These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the law of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms.
